Why Some States Cannot Receive Every Hemp Product

The 2018 Farm Bill removed hemp — cannabis containing less than 0.3% delta-9 THC by dry weight — from the federal controlled substances schedule. That is where most explanations stop, and it is also where the confusion starts. ## Federal legality is a floor, not a ceiling The Farm Bill explicitly preserved the right of states to regulate hemp more strictly than the federal government does. A number of them have. ## Where the restrictions usually land States that restrict tend to target specific product categories rather than hemp as a whole. The most commonly restricted categories are smokable hemp flower, and intoxicating derivatives such as delta-8 and delta-10 THC. Ordinary CBD oils, gummies, capsules and topicals face far fewer restrictions. ## What this means at checkout We maintain a list of states we will not ship restricted products to, and we check it before you pay rather than after. If your state is restricted for something in your cart, checkout will say so. ## The list changes State legislatures revise these rules regularly. A product that could not ship to your state last year may ship this year, and occasionally the reverse.
